User Conditions
NOTICE: Please read these user conditions carefully. They set out the terms under which Livingit.com (i.e.; the Livingit.com website operated by mykindaplace Ltd together with the content, email and other internet services provided by Livingit.com from time to time) is made available to you.
By accessing Livingit.com you confirm that you have read these "User Conditions" and that they agree on your behalf to be bound by these conditions. If you have not read these Terms & Conditions you are not authorised to use this website.
1. Registration
The details provided by you when you register to become a Livingit.com member (allows you to enter competitions, chat on the Forums etc) are important and must be true, correct and complete. You must agree to notify us immediately of any changes which are relevant to your registration emailing info@mykindaplace.com.
2. Your Personal Information
2.1 We will respect your personal information and undertake to comply with all applicable UK Data Protection legislation currently in force.
2.2 In relation to the personal information provided by you on registration (your registration details) you agree that Livingit.com may use such information in accordance with the purposes for which your permission has been obtained on registration (also see Privacy Policy).
2.3 Other than as required by law, or as permitted under these user conditions and in our privacy policy, we will not disclose your registration details to any third party without your permission.
3. Our Obligations to You
3.1 We agree to use our reasonable endeavours to maintain Livingit.com in a fully operating condition and error free. As we cannot guarantee that this will always be the case we do not accept responsibility for any defects that may exist, or for any costs, loss of profits, loss of data, or consequential losses arising from your use of, or inability to access Livingit.com.
3.2 Livingit.com is provided without any warranties or guarantees unless specifically stated.
3.3 Your dealings with, and interest in, promotions, services, or merchants found on or via Livingit.com, unless explicitly stated by us, are solely between you and the person with whom you are dealing. Should any dispute arise between you, Livingit.com will do its best to help you resolve the situation, but we will not be responsible for any losses or damages that may arise from any such dealings.
3.4 We may provide - or our contractual partners may provide - links to other web sites or resources. We are unable to accept responsibility for these; neither can we be deemed to have endorsed their content.
3.5 We reserve the right to suspend, restrict, or terminate your access to Livingit.com for any reason.
3.6 In order to maintain the integrity of Livingit.com we reserve the right to forward contact details to the Police, or other Regulatory authorities where requested to do so; we may also forward contact details where permissible by law where a complaint arises concerning your use of Livingit.com, and where that use is deemed by us to be inconsistent with these user conditions.
4. Your Obligation to Us
4.1 You agree that you will only use Livingit.com in a manner that is consistent with these user conditions and in such a way as to ensure compliance with all applicable laws and regulations. In particular, you will not use Livingit.com to transmit or post any material which is defamatory, offensive, or of an obscene or menacing character, or which may, in our judgement, cause annoyance, inconvenience or anxiety to any person.
4.2 To the extent to which the use by any person causes loss or damage to any person, you agree to indemnify Livingit.com immediately on demand in relation to any such losses or damages attributable to Livingit.com, including where necessary any legal and administrative, or technical charges that may arise from such use.
4.3 Where applicable, you are responsible for maintaining the confidentiality of your username and the password assigned to you on registration. As a result, you are fully responsible for all activities that occur under them. You must notify us immediately of any unauthorised use to which you become aware.
4.4 You confirm you have obtained the telephone line owners consent to access Livingit.com and you acknowledge that you are responsible for obtaining the equipment and paying all telephone charges necessary to access and use Livingit.com. You are also responsible for making your own back-up arrangements.
4.5 You agree that the material and content contained within or provided by Livingit.com is for your personal use only and may not be used for commercial purposes or distributed commercially without our permission. Your use of Livingit.com carries with it no rights in relation to copyright, trade marks or other intellectual property rights in Livingit.com.
4.6 You agree not to use Livingit.com or the services made available to you on or via Livingit.com such that you cause the whole or part of Livingit.com or such services to be interrupted, damaged, rendered less efficient or is in any way impaired.
Competitions conditions
1. All entrants must be over 18 years old.
2. Entrants must enter their personal details to enter the competition. The email address is required so the winner can be contacted and the full postal address is necessary so the prize can be sent out.
3. Only one entry will be accepted per person.
4. The competition is open to UK and Ireland residents only. Overseas players are not eligible.
5. The prizewinners will be selected at random by Livingit.com Limited ("Livingit.com").
6. Only the winners will be contacted personally via email within 28 days after the competition closing date.
7. If any information is requested from the competition winner by the company, and the winner does not contact the company within 21 days with such information, the prize will be forfeited.
8. A list of the winners will be available from Livingit.com.
9. Prizes must be taken as stated and cannot be deferred.
10. There will be no cash alternatives to prizes.
11. In the event of a problem in supplying the prize that you have won, we reserve the right to provide you with a substitute prize of equivalent quality or price.
12. Livingit.com does not accept any responsibility for late or lost entries due to the Internet. Proof of sending is not proof of receipt.
13. Livingit.com decision is final in every situation, including any not covered above and no correspondence will be entered into.
14. Entrants will be deemed to have accepted these rules and to agree to be bound by them.

16. This competition is not open to employees or contractors or Livingit.com's or any person directly or indirectly involved in the organisation or running of the competition, or their direct family members.
17. Livingit.com shall be permitted to exclude any entrant at any time at its sole discretion.

19. The closing date for entries will be specified for each competition.
20. This agreement is governed by the laws of England and Wales.
Registration Prize draw
All entrants must be over 18 years old.
Entrants must have registered as a livingit.com member e.g. have a valid livingit.com username and password.
Only one entry will be accepted per person.
The competition is open to UK and Ireland residents only. Overseas players are not eligible.
The prize is either a case of wine or a luxury food hamper (worth £100 each). The winner, when contacted, will get the choice of either the case of wine or the luxury food hamper. Then the prize will be ordered and delivered to the winners home address as soon as possible.
The prizewinners will be selected at random by Livingit.com on the 1st of each month and will be selected from all those new members that have signed up in the previous month.
Only the winner will be contacted personally via email within 28 days after the competition closing date.
If any information is requested from the competition winner by the company, and the winner does not contact the company within 21 days with such information, the prize will be forfeitted.
